The regulatory context

This is not a trend. It is a legal direction.

EU — Empowering Consumers Directive 2024/825

"Generic environmental claims without recognised excellent environmental performance are prohibited."

In force March 2024. EU member states must transpose by March 2026, applying from September 2026. Terms like "eco-friendly," "green," "climate friendly," and "biodegradable" are banned unless independently substantiated. This is binding law, not a proposal.

Singapore — SGX RegCo & ACRA, 2024

"Companies are better equipped to meet demand from their lenders, customers and investors for sustainability-related information."

From FY2025, all SGX-listed companies must disclose Scope 1 and Scope 2 emissions. The largest listed companies follow with Scope 3 from FY2026. Singapore has made climate disclosure mandatory — not voluntary. The question is no longer whether to disclose. It is whether your disclosures hold up.

United States — FTC Green Guides

"Environmental marketing claims must be truthful, non-deceptive, and substantiated with reliable scientific evidence."

The FTC can issue penalties of up to $50,120 per breach of deceptive environmental claims. California's Truth in Environmental Advertising Act (2024) requires independent certification before claims can be made. State-level enforcement is accelerating where federal action has slowed.

United Kingdom — CMA & FCA, 2024–2025

"Sustainability-related claims must be fair, clear, and not misleading."

The FCA's anti-greenwashing rule has been in effect since November 2024. From April 2025, the UK's Competition and Markets Authority gained direct enforcement power — fines of up to 10% of global annual turnover for misleading environmental claims, without needing to go through the courts.

"We're afraid we won't survive the scrutiny."
